APPLICANT REQUESTS THAT:
He receive active duty credit for the period of time he spent in the Army National Guard (ANG) prior to enlisting in the Air Force.
APPLICANT CONTENDS THAT:
While he enlisted in the Air Force on 7 Aug 57, he originally joined the ANG on 14 Sep 56. His total active duty service was during the period 14 Sep 56 through 19 Sep 58. His military records were destroyed in the fire in St. Louis in Jul 73.
The applicants complete submission, with attachments, is at Exhibit A.
STATEMENT OF FACTS:
The applicant initially entered the Regular Air Force on 11 Oct 57.
On 19 Sep 58, the applicant was furnished an honorable discharge, and discharged in the grade of Airman Third Class.
The remaining relevant facts pertaining to this application are contained in the memorandum prepared by the Air Force office of primary responsibility (OPR), which is attached at Exhibit C.
AIR FORCE EVALUATION:
AFPC/DPSIPV recommends denial indicating there is no evidence of an error or an injustice. There is no documentation in the applicants record, nor did he submit any documentation, which verifies any service prior to 11 Oct 57.
A complete copy of the AFPC/DPSIPV evaluation, with attachment, is at Exhibit C.
APPLICANT'S REVIEW OF AIR FORCE EVALUATION:
He submitted a picture of himself taken in Sep 57 after he graduated from Basic Training, at Lackland AFB, TX. He was then transferred to Davis-Monthan AFB, AZ where he served with the 803rd Air Base Group Headquarters Squadron until his discharge on 19 Sep 58 (Exhibit E).
FINDINGS AND CONCLUSION OF THE BOARD:
After careful consideration of applicants request and the available evidence of record, we find the application untimely. Applicant did not file within three years after the alleged error or injustice was discovered as required by Title 10, United States Code, Section 1552 and Air Force Instruction 36-2603. Applicant has not shown a plausible reason for the delay in filing, and we are not persuaded that the record raises issues of error or injustice which require resolution on the merits. Thus, we cannot conclude it would be in the interest of justice to excuse the applicants failure to file in a timely manner.
THE BOARD DETERMINES THAT:
The application was not timely filed and it would not be in the interest of justice to waive the untimeliness. It is the decision of the Board, therefore, to reject the application as untimely.

On 1 Sep 58 (which was later changed to 1 May 57 per Special Order B-67), he was promoted to the grade of A2C and on 1 Oct 61, he was promoted to the grade of airman first class. _________________________________________________________________ AIR FORCE EVALUATION: HQ AFPC/DPSOE recommends denial and states the application should be time barred. He should have been retired as an LTC under the provisions of the Defense Officer Personnel Management Act (DOPMA). Complete copies of his three DD Form 149s are at Exhibit A. A copy of DPPPRA’s letter is at Exhibit D. In his third application (Exhibit A), dated 28 Aug 00, the applicant again asks that his DD Form 214 reflect “Radiation Veteran/Survivor” and that he be promoted to the grade of LTC under the provisions of DOPMA.

He believes that if he would have been offered a commission when he entered pilot training, he would have been a general officer when he retired.
